Octopz Inc. and its affiliates (hereinafter, "Octopz Inc.", "we", "our" or "us") respects and is committed to protecting your privacy. The goal of the Privacy Statement is to explain how we collect, use and protect your personal information.

Introduction

(a) Application of this Privacy Statement
This Privacy Statement (the “Statement”) applies to personal information collected through this website http://www.octopz.com (the "Site") or through the on-line collaboration service advertised on the Site (the “Collaboration Service”).
(b) Your Consent
By using the Site and/or Collaboration Service, you acknowledge that you have read and understood this Statement and consent to our collection, use and disclosure of your personal information as set forth herein.
(c) Personal Information
"Personal information" is information that can identify you as an individual and includes information such as your name, e-mail and mailing address. Information may cease to be "personal information" when it is stripped of all identifiers or aggregated with personal information collected from other individuals.
(d) Changes to the Statement
We will occasionally update this Statement to reflect changes in our services and customer feedback. When we post changes to this Statement, we will revise the “last updated” date at the top of this statement. If there are material changes to this statement or in how we may use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification. Your continued use of this Site or the Collaboration Service after a change to this Statement has been made signifies your acknowledgement and acceptance of such change.

Consent

In general, you can browse the Site without telling us who you are or revealing any personal information about yourself. In order to provide you certain services or information, including without limitation, the Collaboration Service, we may request that you provide certain personal information, which may include your name, address, e-mail address or any other information from which your identity is discernible. Your provision of such information is voluntary, however, if you elect not to provide such information certain services or information may not be made available to you.

When you voluntarily provide us with your personal information, you are consenting to our collection, use and disclosure of that information for the purposes identified at the time of collection, and as otherwise set out in this Statement.
If you post any of your personal information in areas of the Site or the Collaboration Service that may be viewed by others, you acknowledge that we have no control over such persons and agree that we are not responsible for the use made by third parties of the information you post or otherwise make available to others through the Site or the Collaboration Service.

How We Use Your Personal Information

Octopz uses your personal information to respond to your requests for information, provide customer support and troubleshoot problems. We also use your personal contact information to notify you of information related to your use of our services, such as upgrades, that we consider necessary for your continued use of our service.

With your consent, from time to time Octopz may use your personal contact information to communicate with you about new products and services from us or from third parties that we believe may be of interest to you. Your contact information would not be released directly to these third parties but rather we would send the information on their behalf or through bonded mail-houses or email delivery services.

Withdrawing Consent

If at any time, you decide you do not wish to receive communications from us or you no longer wish to receive our services, you may advise of such decision by clearly following the "unsubscribe" instructions in any email you receive from us, or by providing written notice to the Privacy Officer at the address set out below.

Please be aware that in certain circumstances the withdrawal of your consent to our collection and use of your personal information may mean we may no longer provide you with products and services. We will notify you of the consequences of your withdrawal.

Cookies

"Cookies" are small files of data that reside on your computer and allow us to recognize you as a Octopz user. We send a single "session cookie" to your computer when you first log in to your Octopz account by entering your e-mail address and password. This cookie is a security measure, which allows us to ensure that your session using the Collaboration Service is not interfered with by an unauthorized third party. Once you log out or close your browser, this session cookie will expire and no longer have any effect.
You are always free to decline our cookies if your browser permits, although in that case you will not be able to use the Collaboration Service.

Beacons

This website may contain electronic images known as Web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages and to deliver co-branded services. Web beacons are not used to access your personally identifiable information; they are a technique we use to compile aggregated statistics about our website usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides.

IP Addresses

An IP address is a number that is assigned to your computer when you are using your browser on the Internet. The servers that (operate, manage, attend to) our Site and Collaboration Service automatically identify your computer by its IP address. We do log IP addresses, but we do not link the IP addresses to individual accounts or to personally identify our customers for any reason, except in instances of abuse, misuse or unauthorized use of our Site or Collaboration Service. If we, in good faith, determine that you have provided a false email address, used our services to menace, threaten, harass, intimidate or otherwise deceptively pose as another person, your actions may be investigated and your IP address may be disclosed to the recipient of any email, their legal counsel or representatives, and law enforcement officials as part of such an investigation.

Our Site contains links to other web sites. Please be aware that we are not responsible for the privacy practices of such other web sites. We encourage our users to read the privacy statements of each web site they visit. While we carefully choose the web sites to which we link, this privacy policy applies solely to information collected on the www.octopz.com site and through the Collaboration Service.

Limiting Collection, Use and Disclosure

We only collect personal information about you that we consider necessary for achieving an identified purpose. We do not use or disclose your personal information for purposes other than those identified at the time of collection or as otherwise set out in this Statement. If we want to use your personal information for purposes not identified at that time, we will obtain your consent, unless use of your personal information for the new purpose is required by law.

Disclosure

Octopz will not disclose your personal information except in the limited circumstances described below, or with your consent.
  1. Agent and Contractors. We share information with companies and individuals that we hire to help us perform certain services, such as service hosting, technical support and payment processing. These companies and individuals will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party. Some of these companies and individuals may be located outside of Canada and your provision of personal information through this website or the Collaboration Service constitutes consent to the transfer of your personal information outside of Canada and you acknowledge that foreign governments, courts of law, enforcement or regulatory agencies may obtain disclosure of your personal information through the laws of such foreign countries.
  2. Permitted or Required by Law. Applicable privacy laws in Canada permit or require the disclosure of personal information without consent in limited circumstances. Where permitted or required by applicable laws, we may disclose your personal information. For example, we may disclose your personal information in response to a subpoena, warrant, or court order.
  3. Investigations, Breaches of the Terms of Service or the Terms of Use. We may also disclose personal information that we in good faith believe is appropriate to prevent, take action or investigate suspected fraud, situations involving potential threats to the physical safety of any person, abuse, misuse or unauthorized use of our products and services or other illegal activity, or to prevent, take action or investigate violations of our Terms of Service or the Terms of Use.
  4. Sale of Assets. Octopz may disclose and/or transfer its database, including personal information contained therein, to a third party who acquires all or substantially all of the assets of the company or a portion of our business, whether by merger, acquisition, reorganization or otherwise. In addition, in the event Octopz becomes the subject of a bankruptcy or insolvency proceeding, whether voluntary or involuntary, Octopz or its trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by a court of law.

Retention

We retain your personal information only as long as necessary to fulfill identified purposes, unless a longer retention is permitted or required by law.

Accuracy

Information that you provide to Octopz must be true, accurate and complete. We rely on you to inform us of any changes in your personal information (contact details, address, telephone number or email address) by updating them using the Users Preferences in the Collaboration Service or by contacting us using the Contact Information below.

Safeguards

Octopz uses physical, administrative and technical safeguards to protect your personal information against loss or theft, as well as unauthorized access and disclosure. For example, there are security features built into our Collaboration Service including the timed expiration of passwords to work rooms in the Collaboration Service (each referred to as “The Room “) and our servers for our Site and the Collaboration Service are stored in physically secured facilities. Beyond the physical security of your information, we also back up our servers regularly to prevent loss of data.

You are also responsible for the security of the information disclosed in The Room by exercising care when granting individuals access to The Room. If, after you register for our Collaboration Service, or any other service for which registration is required, you believe that someone has obtained access to your password, please change it immediately and contact us right away using the contact information below.

Access to Information

You have a right to request access to, and to challenge the accuracy and completeness of, your personal information that we have in our possession. Accountability

The Privacy Officer is responsible for Octopz's compliance with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and other applicable privacy legislation.
